It is big Pharma that writes American Drug Policies, the result of these policies is to ban Plants so that nothing but the Synthesized Drugs created in Labs can be made and purchased. The War on drugs is really a War on Medicinal Plants. They ban the plants so they may sell their more Dangerous Drugs, and this is a Crime against Nature, Plant Genocide and medicinal tyranny funded by Pharmaceutical Corps. How did they convince US that it is Just to Ban Medicine? We have been deceived but now We Wake. They cannot ban Plants, unless they convince US and the corporate Policy Enforcement Officers that kicking in doors to Kill medicinal plants and kidnap people is a just action. Now that some Policy Officers know it is actually a Crime to Harm People for growing Plants/Medicine just because Drug Companies think some plants should not Exist. If We knew that Money and Medicine grew from the Ground, then We would have far less need for drug Companies, hence less profit for them, and We can grow our Money, so less need for US to work in the Corporate System for fictional Paper Money. All is provided by nature, so our System bans Nature and forces artificial benefits that they Control. We are in the midst of a great Awakening, and once the illusion of the Corporate System is seen, then the illusion will fail, as it only exist because We believe in it. We will return to nature, renewable energy from Hemp and natural Forces; We will remember that Banks, Governments, and Corporations exist by our Consent, and they exist to Serve US; We do not serve them, unless We believe the Propaganda that they teach US in School and on TV. If We believe a Lie, then We give it Power; If We know the Truth, then the Lie is of no Power. The Truth is making US free, this is the dawn of a new day.

I wanted to share a little bit of hope with all of you. One thing I’ve been trying to figure out is what will we do if our plant gets banned? I’m a lawyer. I know there are legal remedies. Specifically, we could file for an injunction staying enforcement of any ban until the government can prove that its actions are not arbitrary and capricious. But NOBODY is telling us what the contingency plans are. We’re all just terrified that if the DEA acts then we’re toast. But that’s not true.
The DEA and FDA are administrative agencies. They get their power from Congress. Now, Congress could outright ban Kratom if it wanted to. That’s Congress’ right under the Constitution. But Congress has instead chose to delegate that authority to the DEA. Administrative bodies do not have the broad legislative powers that have been constitutionally granted to Congress. Under the Administrative Procedures Act and various other laws, the DEA and FDA are bound by certain substantive and procedural requirements. Imagine if the DEA tried to ban strawberries. Well it can’t. Not without some serious justification based on sound scientific reasons.
Arguably, if the DEA relies upon the FDA’s recent analyses and bans Kratom, they are likely in violation of the law given any such rule would be based on entirely false application of the science behind Kratom. No reasonable person could conclude the ridiculous assertions that the FDA has concluded.
So with that in mind, what happens if we lose? Well, we have access to the Courts. The Courts cannot order that Kratom be made legal. But what they can do is compel the DEA to do its job and to make rules based upon the preponderance of the evidence. The Court can also “stay” any enforcement actions by the DEA. That’s basically a legal end-run around the ban.
I was speaking with a couple of people at the AKA and I’ve asked them if they have lawyers waiting to file an injunction if the DEA bans Kratom. Without revealing their legal strategy to me, I was informed that injunctive relief is definitely in the works.
I’m telling you all of this to give you hope. If the DEA f#cks us, all is not lost. There are legal options available. Honestly, if it comes to that, I may file my own application for injunction. I’m presuming I would be one of at least a handful of people/agencies doing that. I don’t have the resources to fight that kind of fight but it sure would feel good.
As terrified as we all are, know that there are some very intelligent legal minds making backup plans. If Kratom is banned, that ban may only be temporary. What I’m doing is stockpiling enough Kratom to last me hopefully a year or two in case a legal battle ensues.
Just wanted to share that with y’all.March 2, 2018 at 1:06 am #393
I know quite a few vendors will be suing the FDA over the “science” they put out if it causes a ban. Loss of income, which is definitely a lawsuit.April 7, 2018 at 3:07 pm #448
